Terms and Agreement

Ghost Rider Bike Rentals

By hiring an e-bike from Ghost Rider Bike Rentals, you agree to the following Terms and Agreement. Please read them carefully before completing your booking.

1. Hire of e-Bike

1.1 The hiring of the e-bike commences on the agreed commencement date and continues for the hire period.

1.2 The Hirer is entitled to use the e-bike for the agreed hire period, including any approved extensions.

1.3 The Hirer agrees to return the e-bike to the agreed-upon pick-up address by the end of the hire period.

1.4 The Hirer may return the e-bike before the hire period ends if:
a. The e-bike is defective or not fit for its intended purpose.
b. The Hirer no longer requires the use of the e-bike.

1.5 Where the Hirer returns the e-bike early due to:
a. Clause 1.4(a): Ghost Rider Bike Rentals will endeavor to provide a replacement within 30 minutes. If a replacement is unavailable, a pro-rata refund will be issued based on the nearest hour.
b. Clause 1.4(b): No refund will be provided.

2. Payment for Rental

2.1 The Hirer agrees to pay the agreed hire fee, which includes applicable GST, for the hire period.

2.2 The hire fee must be paid in full prior to or on the commencement date.

2.3 In addition to the hire fee, a refundable security deposit of AUD $400 is required. This deposit must be paid prior to or at the time of rental and will be refunded upon the safe return of the e-bike in its original condition.

2.4 Payments can be made via:
a. Credit or debit card.
b. The online payment gateway available on our website.

2.5 All online payments are processed by a third-party payment service provider ("Payment Gateway"). The Hirer agrees to the terms and conditions of the Payment Gateway.

3. Delivery and Pick-Up Service

3.1 Ghost Rider Bike Rentals offers free delivery and pick-up within the local Byron Bay area, defined as Broken Head Beach to the Arts and Industrial Estate.

3.2 For locations outside this free delivery area, a paid delivery service is available to the following areas:

  • Ballina
  • Lennox Head
  • Bangalow
  • Ewingsdale
  • Brunswick Heads
  • Ocean Shores
  • New Brighton

3.3 The delivery fee for these areas is $70 for drop-off and $70 for pick-up.

3.4 If you are unsure whether your address falls within the free or paid delivery area, please contact us for confirmation.

3.5 The Hirer agrees to provide accurate delivery and pick-up address details at the time of booking.

3.6 All deliveries and pick-ups must be scheduled and confirmed in advance.

4. Assumption of Risk

4.1 Riding an e-bike involves risks, including but not limited to:

  • Collisions with vehicles, pedestrians, or other cyclists.
  • Falls or loss of control.
  • Hazards such as weather, road conditions, or unforeseen obstacles.

4.2 By hiring an e-bike, the Hirer assumes full responsibility for any risks, injuries, or damages associated with its use.

5. Waiver of Liability

5.1 The Hirer waives and releases Ghost Rider Bike Rentals, its owners, employees, and agents from any liability for:
a. Injuries or damages sustained while using the e-bike.
b. Loss or damage to personal belongings.
c. Breach of local road and traffic laws.

6. Hirer Responsibilities

6.1 The Hirer agrees to:
a. Wear a helmet at all times (as required by NSW law).
b. Obey all road rules and local traffic regulations.
c. Inspect the e-bike before use and notify Ghost Rider Bike Rentals of any issues.
d. Use the e-bike responsibly and avoid reckless behavior.

6.2 The Hirer confirms that they are:
a. Physically capable of safely operating an e-bike.
b. At least the minimum required age of [insert age, e.g., 18 years].

7. Damage, Loss, or Theft

7.1 The Hirer is fully responsible for the e-bike during the hire period.

7.2 The Hirer agrees to cover costs for:
a. Repairs resulting from damage to the e-bike or accessories.
b. Replacement of the e-bike in case of loss or theft.

8. Refund and Cancellation Policy

8.1 Refunds are subject to the terms outlined in Clause 1.5.

8.2 Cancellations made before the hire period commences may be eligible for a refund, at the discretion of Ghost Rider Bike Rentals, subject to applicable fees.

9. Governing Law

9.1 This agreement is governed by the laws of New South Wales, Australia.

9.2 By proceeding with your booking, you acknowledge and accept these terms.
